Official Rules
NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
1) Promoter
The “Promoter” is Thane USA, Inc., whose registered office is 4050 Whipple Ave. NW, #31, Canton OH 44718
2) Who May Enter
Dr Gordon’s Total Mind Month One (“Giveaway”) is open only to legal residents of the United States, who are aged at least (18) years old at the time of entry, except employees of the Promoter and their close relatives and anyone otherwise connected with Giveaway. Void where prohibited by law.
3) How to Enter
The Giveaway begins on Friday 21st June, 2024 at 0900am EST and ends on June 27th, 2024 at 11:59pm EST (“Draw Period”). No responsibility can be accepted for entries not received for whatever reason. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.
You will be automatically entered into the Giveaway when you like, share and comment on the post.
4) PrizesThe prizes ais as follows:
Dr. Gordon's Total Mind TM System - Month One
The prize is as stated, and no cash or other alternatives will be offered. The prize is not transferable. Promoter reserves the right to substitute any prize with another of equivalent value without giving notice.
5) Odds of Winning
The actual odds of winning will depend upon the actual number of entries received for this Giveaway. There is one prize available as noted above.
6) Random Selection
The "Winner" will be chosen at random by software, from all entries received during the Draw Period. The Winner will be notified of the prize by 29 th June, 2024 by 11.59pm EST and will be contacted directly via email or social media.
Winner is subject to verification by Promoter. Promoter’s decisions are final and binding in all matters related to the administration, operation, selection of the Winner and other matters related to the Giveaway.
7) Redeeming Your Prize
The Winner will be selected on 28th June, 2024, and will be contacted by email or Social Media by the Promoter. If the Winner cannot be notified or contacted for whatever reason, or if the Winner does not claim the prize within the four (4) day period specified above, Promoter reserves the right to withdraw the prize from the Winner. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with the Giveaway.
8) Publicity and Consent
Winners consent to Promoter’s use of their name, photograph and/or likeness, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without further consent or additional compensation, unless prohibited by law, and the Winner agrees to execute any and all documents requested by Promoter to convey such rights to own all the results thereof. Any personal data relating to the Winner or any other entrants will be used solely in accordance with current USA data protection legislation and will not be disclosed to a third party without prior consent.

10) Miscellaneous Conditions.
By participating in this Giveaway, entrants agree to abide by and be bound by these Official Rules, which shall be final and binding with respect to all issues relating to this Giveaway. It is your responsibility to ensure that you have complied with all of the conditions contained in these Official Rules.
If, for any reason, the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond Promoter’s control, Promoter reserves the right, at its sole discretion, and as permitted by law, to cancel, terminate, modify or suspend the Giveaway. Persons who have not complied with these Official Rules, or found tampering with or abusing any aspect of this Giveaway, or whom Promoter believes to be causing malfunction, error, disruption or damage, will be disqualified. Promoter reserves the right to correct any typographical, printing, computer programming or operator errors. Promoter assumes no liability for damage caused to any entrant’s or any other person’s/entity’s computer device hardware, software or communications network, regardless of cause.
By entering the Giveaway, entrants explicitly release, discharge and holds harmless Promoter and its affiliated entities, and their respective shareholders, officers, directors, successors, estates and assigns, from any and all liability, actions, causes of action, damages (actual, incidental or consequential), claims and demands whatsoever in law or equity, including all costs, which they now have or may acquire, by reason of any personal injury, death, loss of or damage to property, or any reason, occurring during or arising out of their participation in the Giveaway.
If any provision of the Giveaway or these Official Rules shall be deemed to violate any federal, state or municipal law, regulation or ordinance, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. If Promoter is required by applicable federal, state or municipal law, regulation or ordinance, or by action of an administrative agency, to cease offering the Giveaway in any jurisdiction, Promoter reserves the right to (i) terminate the Giveaway in such jurisdiction in its entirety, and/or (ii) cancel and remove from participation in the Giveaway the entry of any entrant residing in such jurisdiction, without penalty and without obligation to the affected entrant.
11) Privacy Policy
When entrants enter this Giveaway, Promoter may collect their names, addresses, phone numbers and e-mail addresses. Promoter will use this information to administer entrants’ participation in the Giveaway. By entering the Giveaway, entrants explicitly provide consent for the use of their personal information in this manner. At the time entrants enter the Giveaway, Promoter may ask their permission to send them future marketing information from Promoter. If entrants wish to later opt-out of these emails, they can do so by checking the unsubscribe button on the email. This Giveaway is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter or any other Social Network. You are providing your information to the Promoter and not to any other party. The information provided will be used in conjunction with the Privacy Policy found on the Promoter’s website at https://www.thane.com/policies/privacy-policy.
12) Dispute Resolution/Damages
By entering the Giveaway, entrants agree that any and all disputes, claims, actions and causes of action arising out of or connected with the Giveaway and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively in a court of competent jurisdiction sitting in Canton, Ohio, USA, without regard for conflicts of law doctrine.
For certainty, this Giveaway is governed by the laws of the state of Ohio, USA. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Giveaway and under no circumstances will entrants seek or be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages and any other damages other than for actual out-of-pocket expenses, including any and all rights to have damages multiplied or otherwise increased, and in no event attorneys' fees or costs. Some jurisdictions may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to all entrants.
